By using the website, you agree to these terms. If you use it for an organisation, you confirm that you may accept these terms for that organisation. If you do not agree, please do not use the website.
These terms are an electronic record under the Information Technology Act, 2000. They do not need a physical or digital signature to apply.
1. What these terms cover
These terms cover this website only: its pages, articles, whitepapers, videos and forms.
The DataSurity platform and our professional services are provided only under a separate written agreement. If that agreement and these terms differ, the agreement prevails for the platform or the services it covers.
Nothing on the website is an offer that you can accept to form a contract. Requesting a demo, sending an enquiry or downloading a whitepaper does not create a contract or a client relationship. Features, modules, deployment options and service descriptions are indicative and may change.
2. Who may use the website
The website is meant for businesses and professionals. It is not directed at children.
You may use it only if you are at least 18 years old and can enter into a contract under the Indian Contract Act, 1872.
3. Information on the website is not advice
Articles, whitepapers, guides and videos explain the Digital Personal Data Protection Act, 2023 and the rules made under it. They also cover related requirements of regulators such as RBI, SEBI, IRDAI and CERT-In. This content is general information. It is not legal, regulatory, technical, security or other professional advice.
Laws, rules and regulators' guidance change, and their application depends on your facts. Before acting on anything you read here, take advice suited to your organisation. A professional relationship with SARC AI begins only when we agree to it in writing.
Examples, case studies, figures and results describe particular situations. They do not promise that you will get the same outcome.
We mention regulators, laws and standards to explain how the platform and services relate to them. This does not mean that any regulator approves or endorses us. Our ISO 27001 and ISO 27701 certifications apply to the scope stated on each certificate.
4. Accuracy and availability
We work to keep the website accurate and up to date, but we do not guarantee that it is complete, current or free of errors.
We may change, suspend or withdraw any part of the website at any time, without notice. We do not promise that the website will be available without interruption or free of viruses or other harmful code. Use your own security software.
5. How you may use the website
You may use the website for lawful purposes and in line with these terms. You must not:
- break any law, or use the website to deceive or defraud anyone
- probe, scan or test the website for vulnerabilities, or try to get around its security or authentication, without our written permission
- try to reach any part of the website, its servers or its content management system that is not meant for public use
- disrupt the website or overload it, for example through denial-of-service attacks or automated traffic
- upload, send or link to viruses, malware or other harmful code
- copy content in bulk by scraping, crawling or automated download, except for search engines that follow our robots.txt file
- use the website's content to train, test or improve artificial intelligence or machine learning models without our written permission
- frame or mirror the website, or present its content as part of another website or service
- copy, decompile or reverse engineer the website's code, except as the law allows
- give false details in a form, or pretend to be another person or organisation
- enter another person's personal data in a form unless you are allowed to share it with us
- collect the contact details of anyone named on the website to send them unsolicited messages
- remove or change any copyright, trade mark or other notice on the website or its downloads
Some of these acts may also be offences under the Information Technology Act, 2000.
6. Forms and the details you send us
When you fill in a form, the details you give must be accurate and yours to share. If you act for an organisation, you confirm that you may share its details.
Our privacy notice explains how we use personal data sent through the website and how long we keep it. It also explains how to use your rights under the Digital Personal Data Protection Act, 2023. Marketing messages are sent only if you tick the separate marketing box. You can withdraw that consent at any time on the Email preferences page.
Please do not send confidential or commercially sensitive information through the website's forms. Sending an enquiry does not create a duty of confidentiality. A duty of confidentiality arises only under a written agreement with us.
7. Intellectual property
The website and its content belong to SARC AI, or are used with permission. Content includes text, articles, whitepapers, reports, illustrations, graphics, videos, page design and software. It is protected by copyright and other intellectual property laws.
"DataSurity", "SARC" and their logos are trade marks owned by or licensed to SARC AI. You may not use them without our written permission, except to refer to us accurately.
You may view the website, and print or download reasonable copies of its pages and whitepapers, for your own reference or your organisation's internal use. When you do, you must keep every copyright and source notice. You may not edit, sell, license, republish or distribute the content, or use it in a product or service, without our written permission.
You may quote short extracts, with a clear credit to DataSurity and a link to the page, where the Copyright Act, 1957 allows it.
Names and logos of clients, regulators, standards bodies and other organisations belong to their owners. We show them to identify those organisations or our work with them. Showing them does not mean those organisations endorse the website.
8. Testimonials and case studies
Testimonials and case studies describe the experience of the people and organisations named, and are shown with their permission. They reflect their own views and circumstances. They are not a guarantee of what you will experience.
9. Links, embedded videos and other websites
The website links to other websites and shows videos hosted by YouTube and Vimeo. Those websites and services have their own terms and privacy policies, which apply when you use them. We are not responsible for their content, availability or practices.
You may link to the website's pages, as long as the link is fair and lawful. A link must not suggest that we endorse you or are connected with you when we are not. You must not frame the website.
10. Reporting a security issue
If you believe you have found a security vulnerability in the website, please tell us at the email address below. Include enough detail for us to reproduce it. Do not access or change data that is not yours, and do not disrupt the website. Give us reasonable time to fix the issue before you share it with anyone else.
This section does not give permission to test the website. Section 5 still applies.
11. Our responsibility to you
The website is provided "as is" and "as available". To the fullest extent that the law allows, we exclude all warranties, conditions and representations about the website and its content, whether express or implied. These include any about accuracy, completeness, quality, fitness for a particular purpose and non-infringement.
To the fullest extent that the law allows, SARC AI is not liable for:
- any loss or damage that comes from relying on information on the website
- any indirect, incidental, special or consequential loss
- any loss of profit, revenue, business, goodwill, opportunity or data
These exclusions apply however the loss arises, including in contract, tort or negligence, and even if the loss was foreseeable.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under the law. This includes liability for fraud. Liability for the platform and for our services is governed by the written agreement for them.
12. Your responsibility to us
You agree to compensate SARC AI for any loss, damage, cost or claim caused by your breach of these terms. The same applies to any loss caused by your breach of the law when using the website. This includes reasonable legal costs.
13. Suspending access
We may block or restrict anyone's access to the website at any time if we reasonably believe they have broken these terms. We may also do so to protect the website, its users or our systems.
14. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. The terms in force when you use the website are the ones that apply. If you keep using the website after a change, you accept the updated terms.
15. Law and disputes
These terms, and any dispute about the website or these terms, are governed by the laws of India.
If you have a concern, please write to us first. We will try to resolve it within 30 days of receiving your message.
The courts at New Delhi have exclusive jurisdiction over any dispute about the website or these terms.

- Whole agreement. These terms and our privacy notice are the whole agreement between you and us about the website.

- No waiver. If we do not enforce a right straight away, we can still enforce it later.

- No partnership. Nothing in these terms creates a partnership, agency or employment relationship between you and us.
